Terms of Service

1. Agreement

These Terms of Service (the "Terms") are a contract between you and [Legal Entity Name] ("TipTop VPN," "we," "us," or "our"). They apply to the TipTop VPN application, VPN connection service, and optional subscription features (together, the "Service").

You also agree to our Privacy Policy, which explains how information is handled. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service

TipTop VPN provides an iOS interface for selecting and managing supported VPN connections. The Service may include free and premium nodes, system VPN configuration, connection status, and subscription-only features.

TipTop VPN does not guarantee that every node will be available in every country, that a node's displayed location will be the physical location of the server or internet exit, or that the Service will meet a particular speed, latency, privacy, or availability requirement.

The Service may use Apple NetworkExtension, Apple StoreKit, Firebase Remote Config, and infrastructure operated by TipTop VPN or its providers. Features and node availability may change without notice when needed for maintenance, security, compliance, or operations.

3. Eligibility and Accounts

You must be legally able to enter into these Terms. If you are under the age of majority in your location, use the Service only with the involvement and permission of a parent or legal guardian.

You are responsible for your Apple Account, device security, and all activity performed through your device. Do not share access to a premium subscription or use another person's Apple Account without authorization.

4. Subscriptions and Automatic Renewal

TipTop VPN may offer auto-renewing subscriptions through Apple's In-App Purchase system. Current product identifiers include weekly_3days_trial and TipTop_annual_premium. Product names, prices, billing periods, trial offers, eligibility, and taxes shown in the App Store or purchase sheet control the transaction.

Payment is charged to your Apple Account when you confirm the purchase. Unless you cancel in accordance with Apple's process, an auto-renewable subscription renews at the end of each billing period and your Apple Account may be charged the then-current price. A free or discounted trial, if offered, converts to the applicable paid subscription unless canceled before the trial ends.

Only one Apple Account can be associated with a purchase. You may use the app's restore purchase action to restore eligible transactions on another device signed in to the same Apple Account. Premium access is subject to a verified and current entitlement.

5. Refunds and Cancellation

You can manage or cancel an Apple subscription in your Apple Account subscription settings. To avoid the next charge, cancel at least 24 hours before the current billing period or trial ends, or earlier if Apple's process specifies a different deadline.

Apple controls billing and generally handles refund requests for App Store purchases. Request a refund through Apple's official support or purchase history process. Deleting the app does not automatically cancel a subscription and does not by itself create a refund right.

6. Acceptable Use

You may use the Service only for lawful purposes and in compliance with these Terms. You must not:

• use the Service to violate law, court orders, sanctions, or the rights of others;
• transmit malware, exploit code, spam, or content that facilitates abuse or fraud;
• attempt to gain unauthorized access to the Service, a node, another account, or a network;
• interfere with node operation, evade reasonable usage controls, or consume resources in a way that harms others;
• reverse engineer, decompile, modify, or redistribute the app except where applicable law expressly permits it;
• resell, sublicense, share, or commercially exploit the Service without our written permission; or
• use the Service in a way that could expose TipTop VPN or its providers to legal, security, or operational harm.

We may limit or suspend access to protect users, nodes, the Service, or third parties when we reasonably believe these rules have been violated.

7. Availability and Changes

The Service is provided over networks and systems that can experience outages, congestion, maintenance, filtering, or incompatible device and carrier conditions. We may add, remove, suspend, or change nodes, protocols, features, and subscription offerings.

We do not promise uninterrupted or error-free operation. You are responsible for maintaining a compatible device, current operating system, internet access, and any carrier or network charges.

8. Disclaimer

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or secure operation.

A VPN can reduce exposure on some networks, but it does not make you anonymous, prevent all tracking, guarantee security, or protect you from malicious content, account compromise, or mistakes. You remain responsible for your online activity and for using appropriate security controls.

9. Limitation of Liability

To the maximum extent permitted by law, TipTop VPN and its owners, employees, contractors, providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, business, or access, arising from or related to the Service or these Terms.

To the maximum extent permitted by law, our total liability for all claims related to the Service will not exceed the greater of the amount you paid us for the Service during the twelve months before the event giving rise to the claim or 100 US dollars.

Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, the exclusions and limits apply only to the extent permitted by law.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, create risk for the Service or others, fail to pay an applicable charge, or if we discontinue the Service.

Termination does not automatically cancel an Apple subscription. Provisions that by their nature should survive termination, including payment obligations, acceptable use consequences, disclaimers, limitations of liability, and dispute terms, will survive.

11. Changes to These Terms

We may update these Terms when the Service, law, or business practices change. We will post the updated version at the same URL and update the effective date. Your continued use of the Service after the updated Terms take effect means you accept them. If a change materially affects your rights, we will provide additional notice where required.

12. Governing Law and Disputes

These Terms are governed by the laws of [Governing Law Jurisdiction], without regard to conflict-of-law rules. Courts located in [Dispute Venue] will have exclusive jurisdiction unless applicable law gives you a right to bring a claim elsewhere.

Before filing a formal claim, please contact us and provide a reasonable opportunity to resolve the issue. Nothing in this section limits non-waivable consumer rights.
